AHRC calls for impartial probe into alleged involvement of 4 armymen in extortion case
ITANAGAR, Aug 13: Asian Human Rights Commission (AHRC) has urged the concern Army officials in the administration and in the armed forces to carryout an impartial, free, and fair investigation into the alleged involvement of four army personnel in July 18 extortion and burglary case in Arunachal Pradesh.
While expressing grave concern over the alleged involvement of army deployed to counter insurgency in Assam in extortion, AHRC demanded immediate suspension of those army personnel involved in the incident till the investigation is completed and appropriate punitive action upon completion of the investigation, if the accused are found guilty.
It also demanded to provide adequate compensation to the victim of the burglary and extortion.
In the meantime, AHRC urged the government of India to repeal Armed Forces Special Powers Act, 1958, from the North East of India, where it provides virtual immunity to armed forces for acts of corruption, violence, and violation of human rights.
The AHRC will write a separate letter to the UN Special Rapporteur on Rights of the Indigenous Peoples calling for intervention into this matter.
As per Supreme Court guidelines in the Naga People’s Movement for Human Rights vs. Union of India, 1997, before launching any raid/search, definite information about the activity is to be obtained from the local civil authorities as army deployment is merely to ‘aid the civil authority’.
Since no such request for cooperation from local police was sought in this case, there is reasonable doubt that the army officials with the help of civilians might have been involved in extortion and burglary, AHRC observed.
At present, there is a general apprehension that a proper investigation will not be possible, as the armed forces empowered with AFSPA enjoy virtual immunity, and the Act prescribes prior sanction for initiating legal proceedings against the armed forces.
An independent investigation may get vexed as the army PRO termed the allegations as ‘baseless’ before the media on July 23, 2013, and also added that ‘weapon, ammunitions and equipments are carried by army personnel as they are authorized as per the nature of their duty’. On 18 July 2013, four army officials along with five civilian touts were arrested by the Arunachal Pradesh police while they were attempting to escape with looted money.
Local civil society in Arunachal doubts free and fair investigation into the case and apt punishment for the perpetrators as special security laws like the Armed Forces Special Powers Act, 1958, are often used to provide virtual immunity for army personnel from legal proceedings, the release added.

To add fuel to the fire, the recent controversial supposed act of granting citizenship to the Chakma inhabitants in East Arunachal by the JHPC along with Takam Sanjoy M.P (West), Convener of North East MP forum, in the Social networking sites has been a topic of discussion of the scholars, housewives, active college youths and the bored peons and drivers in the government offices.
Well, if history is not to be denied, Chakma-
It is interesting to note that the entire migration and infiltration of the Chakmas from erstwhile East Pakistan (now Bangladesh) into Assam and Tripura happened due to displacement caused by the Kaptai Hydel Power Project (read: Dams with capacity of 80 MW )in 1962 located pin Karnaphuli river, 65 kilometers upstream from Chittagong, Bangladesh. (So, here arises a serious question of the displacement, migration and resettlement strategy of the state Government in Arunachal Pradesh with the upcoming Mega dams?)

Thus, NHRC sought for report from Govt of Arunachal Pradesh on the repeated allegation upon AAPSU by CCRC. However, getting no response it recorded it up as a prima facie conclusion that officers in Arunachal were in fact, hand in glove with AAPSU and its act. Thus, without delay, NHRC approached the Court for the appropriate relief. Thus, the PIL was filed as National Human Rights Commission v. State of Arunachal Pradesh (1996) SCC 742. Whereby, GoAP and the Union of India were the first and the second respondent, respectively.
According to the Constitution, the union of India has the sole Authority to grant citizenship and since the Citizenship Right is governed by the Citizenship Act, 1955; the State government has no jurisdiction in the matter.
Thus, the matter got highlighted on the definitions of Citizenship and their rights;
those who migrated to Assam before 1966 and the commencement of Citizenship Amendment
Act 1985, had to apply for citizenship through registration. Also, uprooting families
with more than 2 decade of settlement was looked into as utter violation of human
rights by the court. Thus, Khudiram Chakma and the 56 families that migrated to India
on 1964, were allotted a refugee camp at Ledo by the Central Government, and then
shifted it to Miao. Meanwhile, AAPSU challenged the act of some Chakma family buying
land in nearby villages of the camp and going beyond the provisions of Bengal Regulation
Act, 1873. Also, AAPSU looked at Chakma-
Therefore, looking into it, the Supreme Court finally concluded by ensuring life and liberty to the Chakma and Hajong, directing the State Government to deal all matters relating, in accordance with Law without evicting the population or denying them domestic life. Also, the central government was directed to ensure their safety and dispatch battalions if need be.
Now, after almost 2 decades of utter confusion which still lingers on Chakma-

‘Negligence of duty by boatmen harassing passengers’

Some eminent citizens of Pasighat and Mebo area in East Siang district alleged gross
negligence of duty by the boatmen entrusted to operate the mini machine-
According to sources, the local MLA has funded the boatmen under his Local Area Development fund. As such, a local businessman has been given the contract at Rs 27,000 per month.
When contacted, Mebo Additional Deputy Commissioner Oti Dai informed that full responsibility of crossing the river has been assigned to the local Anchal chairperson.
“The Mongu Banggo Anchal Chairperson is looking after all the arrangements for crossing the river and he will inform civil administration if there is any problem,” said the ADC.
The ADC said that the authority is not informed of the rates fixed for vehicles, animals and other goods for crossing the river.

PTM is boon for farming community: DAO
PASIGHAT, Aug 13: For the first time in the state, a power operated Paddy Transplanting Machine (PTM) was demonstrated in WRC field by the Agriculture department. The program was a part of the initiatives taken by the department to make the farmers aware about the latest technological interventions and to prepare them to adopt mechanization so that the production could be increased under National Food Security Mission.
Productivity improving technologies are those technologies that lowered the traditional factors of production of land, labor capital, materials, energy etc and finally enhance economic output, stated the East Siang DAO Ojong Yomso while demonstrating a paddy transplanting machine at Jarkong village under Pasighat block.
The innovative demonstration was carried out by ADOs Mirem Perme and Naking Nonang in the WRC field of Oson Yomso and hundreds of villagers.
The DAO while interacting with the villagers said, one of the greatest challenges for growers is labor crisis and therefore growers should look to mechanize their operations as much as possible replacing human labors. SEPPA, Aug 13: The District Level Vigilance and Monitoring Committee (DLVMC) under the chairmanship of Tarin Dakpe, DC cum CEO, DRDA held at Kameng Hall, Seppa yesterday.
While initiating the discussion, Tarin Dakpe said that constant monitoring of the schemes through physical verification and field visits by the implementing agencies were the requisites in order to ensure quality of works and practical achievement.
He urged the PRI members to monitor the schemes in their respective jurisdiction
and give necessary feedbacks as they are also the part and parcel of Govt. for the
success of the schemes. He suggested the PRI members to take up income generated
schemes and schemes of creating assets of permanent nature under MGNREGA rather than
stereo-
He directed the officers to stay at their posting place more especially the BDOs & CDPOs render services at the doorstep of the people to know the ground realities. He added there should be camp office system at district HQ.
He expressed displeasure for failing to present physical and financial status by the Dy. Director, ICDS, and directed her to bring actual status of the activities and progress report in the next meeting. He also directed CDPOs to ensure that the SNP items are fresh and consumable.
Talking about destruction of CDPO Qtr at Chayang Tajo, he said definitely, we will take action against those who destroyed Govt properties but cautioned that there shouldn’t be interference from any corner for seeking bail petition. Further he directed the executing agencies to pay extra care on selection of contractors and select those who are capable of doing the work properly as per direction of the implementing agencies. It should also be noted that the scheme should be carried out in a time bound manner in order to avoid cost escalation.
Meyuk Cheda, Chairperson Zilla Parishad called on the officers and PRI members to work in unison for the greater interest of the people. She appealed the PRI members for proper monitoring of all the schemes in their jurisdiction and see that everything was in proper manner.
PD, DRDA Kego Jilen said that compulsory photographs/Video graphs of all schemes by the BDOs & CDPOs be done for power point presentation in the next meeting. He directed BDOs not to make payment without expected level of works under MGNREGA.
Talking about job cards, he said that BDOs should rectify in case of any double job cards issued to one family and select the genuine one. He also stressed on timely feedback of expenditure report & returns by BDOs and uploads in the net.

CMJ student deprived

The recent acts of the state education department has left hundreds of CMJ University B.Ed degree holders, upset and disillusioned. The recent announcement of compulsory B.Ed degree or D.El.Ed for facing the APTET exam prompted many graduates and postgraduate degree holders to pursue the required degrees. The present no. of institutes in the state offering such degrees have not been able to cater to the requirement of students, hence prompting many to pursue the degree outside the state.
Among the numerous universities offering B.Ed degrees, CMJ University based in Shillong
is one of them. With the notification of compulsory training for teacher’s deadline
fixed for 2015, there has also been a mad rush for obtaining the required degree.
